These terms apply to the Cozy: Daily Affirmations app for iPhone ("Cozy", "the app"), published by Andre Kempe, an individual based in Switzerland ("I", "me"). By downloading or using the app, you agree to these terms. If you don't agree, please don't use the app.

1. Who can use Cozy

Cozy is suitable for all ages. If you are under the age of majority where you live, please read these terms with a parent or guardian, who agrees to them on your behalf.

2. Not medical advice

Cozy offers affirmations for everyday encouragement and self-reflection. It is not therapy, medical or psychological treatment, or a substitute for professional help, and it doesn't diagnose or treat any condition. If you are struggling, please talk to a doctor or mental health professional.

If you are in crisis or thinking about harming yourself, contact your local emergency number right away. In Switzerland you can call Die Dargebotene Hand / La Main Tendue on 143; in the EU, 112; in the United States, call or text 988.

3. Your license to use the app

I grant you a personal, non-exclusive, non-transferable license to use Cozy on Apple devices you own or control, as allowed by the Apple Media Services Terms and Conditions. You may not copy, modify, resell or redistribute the app or its content, or try to extract its source code, except where the law allows it.

4. Content

The affirmations, illustrations, themes and design of the app belong to me or my licensors. You're welcome to share individual affirmations with friends for personal, non-commercial use, as the app's Share button lets you do.

Photos you add for custom themes stay yours and stay on your device.

5. Privacy

Cozy keeps your information on your device. See the Privacy Policy for details.

6. Availability and changes

I may update, change or stop offering the app or any feature at any time. I'll try to keep it working well, but I can't promise it will always be available or free of errors.

7. Disclaimer

The app is provided "as is" and "as available", without warranties of any kind, to the extent the law allows.

8. Limitation of liability

To the extent the law allows, I am not liable for indirect or consequential damages, or for any loss arising from your use of or inability to use the app. Nothing in these terms limits liability for intent or gross negligence, or any rights you have as a consumer that can't be excluded by law.

9. Apple

These terms are between you and me, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the app. Apple is not responsible for any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property infringement claims. You confirm that you are not located in a country subject to a U.S. Government embargo or listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Governing law

These terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in the courts there.

11. Changes to these terms

I may update these terms from time to time. The current version is always on this page, with its effective date. If you keep using the app after a change, you accept the updated terms.
